Terms of Service

By creating or using a Performance Horse World (PHW) account or using PHW services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not create an account or use the services.

You are responsible for providing accurate account information, keeping your login credentials secure, and for activity performed through your account. You may not impersonate another person or business, create deceptive accounts, or use PHW for fraud, harassment, spam, or unlawful activity.

Horse profiles may contain information supplied by owners, managers, riders, trainers, producers, public records, or other authorized sources. Account access to a horse profile does not by itself establish legal ownership of the horse. PHW may review, limit, transfer, or remove profile access when resolving ownership, management, impersonation, duplicate-profile, or account disputes.

Users are responsible for the accuracy of results, earnings, times, placings, eligibility information, documents, and other performance data they submit. Performance Proof and verification indicators are intended to improve transparency, but PHW does not guarantee that every submitted record is complete, error-free, or independently verified. PHW may review, dispute, correct, label, restrict, or remove records when appropriate.

You retain ownership of content you submit, including photos, videos, documents, text, and performance information, to the extent you own those rights. You grant PHW a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, transmit, and otherwise use that content as reasonably necessary to operate, improve, promote, and provide PHW services. You represent that you have the rights and permissions needed to submit the content.

PHW branding, logos, original software, interface designs, original written content, proprietary workflows, and other PHW-created materials are owned by or licensed to PHW and are protected by applicable intellectual-property laws. You may not copy, scrape, reverse engineer, republish, sell, or commercially exploit PHW software or proprietary content except as permitted by law or with written permission. These terms do not claim ownership over general ideas, facts, horse information, competition concepts, or industry practices.

You may not interfere with PHW systems, bypass access controls, introduce malicious code, harvest private user information, use automated tools in a way that materially burdens the service, submit knowingly false proof, manipulate verification, or use PHW to violate another person's privacy, publicity, copyright, trademark, or other rights.

PHW may display sponsors, advertisements, links, or third-party services. A sponsor placement or link does not guarantee or endorse a third party's products, services, claims, or availability. Separate sponsorship, advertising, sales, or paid-service terms may apply when those services are offered.

PHW may add, change, suspend, or discontinue features and may restrict or terminate accounts that violate these terms, threaten the platform or its users, create legal risk, or misuse PHW. We may preserve records when reasonably necessary for security, dispute resolution, legal compliance, or platform integrity.

PHW is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted availability, error-free data, specific results, horse value, eligibility, competition outcomes, or the accuracy of user-submitted information. PHW is not a substitute for official registry, association, event, veterinary, legal, financial, or ownership records.

To the extent permitted by law, PHW and its owners, operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service, loss of data, reliance on user-submitted information, third-party conduct, or inability to access PHW.

We may update these terms as PHW develops. Material changes may require renewed acceptance or additional notice. The version and effective date shown at the top identify the terms currently in effect.
